We are strongly committed to letting you know how we will collect and use your personal information.  The policies below are applicable to data and information collected when you use the EGM Media, LLC (“EGM”) websites, including www.EGMNOW.com (including any versions optimized for viewing on a wireless or tablet device); all email newsletters published or distributed by EGM; and all other interactive features and communications provided by EGM (“Sites”), however accessed and/or used, that are operated by us, made available by us, or produced and maintained by EGM, (“EGM” or “we”, “us”, or “our”).  We have established this privacy policy (“Privacy Policy”) to let you know the kinds of personal information we may gather during your use of the Sites, why we gather your information, what we use your personal information for, when we might disclose your personal information, and how you can manage your personal information.  

Please be advised that the practices described in this Privacy Policy apply only to information gathered online through our Sites. It does not apply to information that you may submit to us offline or by companies or organizations to which we may link or who may link to us. 

By using our Sites, you are accepting the practices described in our Privacy Policy.  If you do not agree to the terms of this Privacy Policy, please do not use the Sites.  We reserve the right to modify or amend the terms of our Privacy Policy from time to time without notice. Your continued use of our Sites following the posting of changes to these terms will mean you accept those changes.  If we intend to apply the modifications or amendments to this Privacy Policy retroactively or to personal information already in our possession, we will provide you with notice of the modifications or amendments.

Visiting our Sites or using our services from outside the United States

If you are visiting our Sites or using our services from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States. The data protection and other laws of the United States might be different from those in your country, but please be assured that we take steps to ensure that your privacy is protected in accords with this policy. By using our services and voluntarily submitting your information to us, you consent to the general use of such information as provided in this Privacy Policy and to the transfer of that information to and storage of that information in the United States.  

What Information About Me Is Collected and Stored?

Non-Personal Information

When you interact with the Sites, we may collect certain information that does not identify you individually, but may include tracking and usage information about your location, demographics, use of the Sites and Internet (“Non-Personal Information”). Much of this information is collected through cookies, web beacons, and other tracking technologies, as well as through your web browser or device. Generally, we collect and store the following categories of Non-Personal Information:

  • Device information about your computer, browser, mobile device, or other device that you use to access the Sites.  This information may include browser type, browser language, and other transactional information.
  • Analytics and usage information about your use of the Sites.  
  • Additional “traffic data” and log files such as time of access, date of access, software crash reports, session identification number, access times, and referring Sites addresses.
  • Other information regarding your use of the Sites that is not personally identifiable information.

Use of Cookies and Other Tracking Technologies

We may use cookies to monitor traffic, improve the Sites and make it easier and/or relevant for your use.  Like many Sites, we use various technologies, including cookies, web beacons, embedded scripts, location-identifying technologies, device recognition technologies, in-app tracking methods, and other tracking technologies now and hereinafter developed (“Tracking Technologies”) to collect information about you and our interaction with our Sites. We may also use these Tracking Technologies to monitor traffic, improve the Sites and make it easier and/or relevant for your use.  If you delete your cookies or if you set your browser or device to decline these Tracking Technologies, some features of the Sites may not work or may not work as designed.  

  • We use cookies to determine the browser the visitor uses so the Sites can be designed to work properly with the most common versions of different browsers. 
  • We use cookies in conjunction with analysis of your use of our Sites and generate analytics regarding our Sites, which may include exiting pages, page views, time spent on a page, number of clicks, application you used or the games you played, how long you used or played it and when, and other usage statistics.
  • We use cookies to estimate our audience size. Your browser is given a unique cookie that helps us determine whether yours is a repeat visit or a first visit. 

Information Regarding Children

Our Sites are intended for a general audience and are not intended for use by children, especially those under the age of 13. If you are under 13 years of age, you should not use our Sites. We will comply with the Children’s Online Privacy Protection Act, and not knowingly provide children under the age of 13 with access to EGMNOW.com.

How Do We Use Your Information?

We may use your Non-Personal Information in the following ways:

General Uses

  • To communicate with you about your inquiries of us; 
  • To communicate with you about changes to our policies;
  • To personalize content and experiences on our Sites, including providing you reports, recommendations and feedback based on your preferences;
  • To optimize or improve our products, services, and operations;
  • To automatically update the Sites on your device;
  • To manage and customize advertisements or promotional offers;
  • To detect, investigate, and prevent activities that may violate our policies or be illegal;
  • To perform statistical, demographic, and marketing analyses of users of the Sites; 
  • For internal purposes such as auditing and data analysis.

Who Do We Provide Your Information To?

Except as disclosed in this Privacy Policy, we do not disclose information about your Non-Personal Information collected online to any companies not part of EGM or its parent, subsidiaries or related entities.  In no event will we sell or rent your Non-Personal Information as part of a customer list or similar transaction.

Business Partners and Third Parties

We may share your Non-Personal Information with our other business partners working with us from time to time as part of our delivery of our products and services.  

Third-Party Agents

We have third party agents, subsidiaries, affiliates and partners that perform functions on our behalf, such as hosting, push notifications, storage, content management tools, analytics, customer service, fraud protection, etc.  These entities may access to the Non-Personal Information needed to perform their functions and are contractually obligated to maintain the confidentiality and security of that Non-Personal Information.  They are restricted from using, selling, distributing or altering this data in any way other than to provide the requested services to the Sites. 

How Long Do We Keep Your Information?

Following termination or deactivation of your account, EGM, its affiliates, or its service providers may retain Non-Personal Information for a commercially reasonable time for backup, archival, and/or audit purposes.  If you have any questions about termination or deactivation of your account, please contact us directly at privacy@egmnow.net. 

What Happens When I Link To or From Another Site?

The Sites may contain links to other sites operated by third parties. Please be advised that the practices described in this Privacy Policy for EGM do not apply to information gathered through these other sites. We are not responsible for the actions and privacy policies of third parties and other sites.  

Changes to This Policy

As our Sites continue to develop, we may add new services and features to our Sites. In the event that these additions affect our Privacy Policy, this document will be updated appropriately.  We will post those changes prominently so that you will always know what information we gather, how we might use that information and whether we will disclose it to anyone.  We do, however, recommend that you read this Privacy Policy each time you use our Sites in case you missed our notice of changes to the Privacy Policy.  We will not, however, materially change our policies and practices to make them less protective of Personal Information we have previously collected from you without your express consent.

Information for Users in Europe and Elsewhere Outside The U.S.

If you use our Sites outside of the United States, you understand that we may collect, process, and store your personal information in the United States and other countries.  The laws in the U.S. regarding personal information may be different from the laws of your state or country.  Any such transfers will comply with safeguards as required by relevant law.  If applicable, you may have a right to claim compensation for damages caused by a breach of relevant data protection laws.  

Your California Privacy Rights 

We provide California residents with the option to opt-out of sharing “personal information” as defined by California’s “Shine the Light” law with third parties, for such third parties’ own direct marketing purposes.  California residents may exercise that opt-out, and/or request information about EGM’s compliance with the Shine the Light law, by sending a letter to EGM at 21781 Ventura Blvd., Woodland Hills, CA 91364.  Requests must include “California Privacy Rights Request” in the first line of the description and include your name, street address, city, state, and ZIP code.  Please note that EGM is only required to respond to one request per customer each year.

The California Consumer Privacy Act (“CCPA”) provides California residents with rights to receive certain disclosures regarding the collection, use, and sharing of “Personal Information,” as well as rights to know/access, delete, and limit sharing of Personal Information, and the right not to be discriminated against for exercising any of these rights. The CCPA defines “Personal Information” as “information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household.” To make such a request, please send an e-mail to privacy@egmnow.net.
